Terms of Service

These terms cover your use of the sendvia.io website, dashboard and API.

01The service

sendvia provides a hosted dashboard, REST API and SMTP relay that sits in front of your own Amazon SES account. sendvia does not itself deliver mail; all outbound mail is sent through the AWS account whose credentials you provide.

By creating an account you agree to be bound by these terms and to our Privacy Policy. You also agree to Amazon Web Services' Service Terms as they relate to your AWS account.

02Acceptable use

You may only use sendvia to send mail recipients have opted in to receive. In particular, you agree not to:

All marketing and newsletter emails must include a functional unsubscribe mechanism. sendvia's newsletter feature includes this automatically. We reserve the right to suspend or terminate accounts that violate these rules, with or without notice depending on severity.

03Your AWS account and mail costs

sendvia sends through your Amazon SES account. As a result:

sendvia will never make AWS API calls outside the scope required to send mail and read delivery metrics.

04Sending limits and plans

sendvia enforces per-account sending limits based on your plan:

Limits are subject to change. We will provide reasonable notice of material changes to plan limits.

05Bounce and complaint rates

High bounce and complaint rates damage the deliverability of all senders using the Amazon SES infrastructure. You must monitor and maintain bounce and complaint rates within Amazon SES's published acceptable thresholds.

We reserve the right to suspend or terminate accounts that generate excessive bounces or complaints, or that Amazon SES flags for policy violations, without prior notice.

06Pricing and payment

Monthly fees are billed in advance.

Failed payments put the account into a past_due state with a 7-day grace period before send access is suspended.

07Refunds and cancellations

You can cancel at any time from the billing page. Cancellation takes effect at the end of the current billing cycle; no pro-rata refunds are issued for the unused portion. We may refund at our discretion in cases of demonstrated technical fault or billing error.

08Data ownership

You own the mail content, mailing lists, and log data in your account. We claim no rights over any of it. See the Privacy Policy for how it's handled.

09Account termination

We may suspend or terminate accounts that:

On termination, your data is retained for 30 days and then permanently deleted. You may close your account at any time from the dashboard.

10Service availability and delivery

Email delivery depends on Amazon SES and is subject to Amazon's service availability, recipient mail servers, spam filters, and other factors outside our control. sendvia makes no guarantee that any email will be delivered, delivered within a particular time, or not classified as spam by the recipient's email provider. For Amazon SES's own SLA see the SES Service Level Agreement.

11Limitation of liability

To the maximum extent permitted by law, sendvia is provided "as is" and without warranty. We are not liable for indirect, incidental or consequential damages, including lost revenue or lost opportunity, arising from your use of the service.

Our aggregate liability in any 12-month period is capped at the greater of (a) the fees you paid sendvia in the preceding 12 months or (b) US $100.

12Disclaimer of warranties

We do not warrant that (i) the service will be uninterrupted or error-free, (ii) defects will be corrected, or (iii) the service will meet your specific requirements. Email deliverability depends on many factors outside our control, including your sender reputation.

13Governing law

These terms are governed by the laws of England and Wales. Any dispute not resolved through good-faith negotiation within 30 days shall be resolved in the courts of London, UK.

14Changes to terms

We may update these terms from time to time. Material changes will be notified by email at least 30 days in advance. Continued use of the service after the effective date constitutes acceptance.
