Terms of Service

1. The service

sendvia provides a platform that allows you to send transactional and bulk emails through your own Amazon Simple Email Service (SES) account. sendvia acts as an interface and management layer; the actual delivery of email is performed by Amazon SES using credentials you supply.

By using sendvia you also agree to Amazon Web Services' Service Terms, including the SES Service Level Agreement, as they relate to your AWS account.

2. Acceptable use

You may only use sendvia to send emails that comply with all applicable laws and regulations. In particular:

• Consent required — you must have a legal basis to email each recipient. For marketing and newsletter email this means prior, explicit opt-in consent. For transactional email the recipient must have a direct relationship with you (e.g. they created an account, placed an order).
• No spam — sending unsolicited bulk email (spam) is strictly prohibited. This includes purchasing email lists, scraping addresses, or any form of email harvesting.
• Legal compliance — you are responsible for complying with applicable email laws including CAN-SPAM (US), CASL (Canada), GDPR (EU/UK), and any other regulations applicable in the jurisdiction(s) you send to.
• No harmful content — you may not use sendvia to send phishing emails, malware, illegal content, or content that threatens, harasses, or deceives recipients.
• Unsubscribe — all marketing and newsletter emails must include a functional unsubscribe mechanism. sendvia's newsletter feature includes this automatically.

3. Your AWS credentials and account

sendvia requires you to provide your own AWS Access Key ID and Secret Access Key to connect your SES account. You are solely responsible for:

• The security of your AWS credentials. We recommend creating a dedicated IAM user with only the necessary permissions (AmazonSESFullAccess and AmazonSNSFullAccess) and not reusing credentials from other systems.
• All costs incurred in your AWS account as a result of using sendvia, including SES sending charges and SNS notification charges.
• Requesting SES production access in your AWS account. New AWS accounts are placed in the SES sandbox and can only send to verified addresses until production access is granted.
• Maintaining your AWS account in good standing. If your AWS account is suspended or your credentials are revoked, email sending will fail.

sendvia stores your AWS credentials securely in our database and uses them only to make API calls on your behalf. We do not share your credentials with any third party.

4. Content responsibility

You are solely responsible for all email content sent through sendvia. sendvia is a sending platform and does not review, endorse, or take responsibility for the content of emails sent by users.

By using the service you represent and warrant that your email content does not violate any applicable law, infringe any third-party intellectual property rights, or violate these terms.

5. Sending limits and plans

sendvia enforces per-account sending limits based on your plan:

• Free plan — limited to a set number of emails per day and a limited number of verified sending domains, as published on the pricing page.
• Premium plan — higher daily send limits and domain limits, as published on the pricing page. Premium status expires at the end of your billing period.

Limits are subject to change. We will provide reasonable notice of material changes to plan limits.

6. Bounce and complaint rates

High bounce and complaint rates damage the deliverability of all senders using the Amazon SES infrastructure. You must monitor and maintain bounce and complaint rates within Amazon SES's published acceptable thresholds.

We reserve the right to suspend or terminate accounts that generate excessive bounces or complaints, or that Amazon SES flags for policy violations, without prior notice.

7. No delivery guarantee

Email delivery depends on Amazon SES and is subject to Amazon's service availability, recipient mail servers, spam filters, and other factors outside our control. sendvia makes no guarantee that any email will be delivered, delivered within a particular time, or not classified as spam by the recipient's email provider.

We do not provide an uptime service level agreement. For Amazon SES's own SLA see the SES Service Level Agreement.

8. Account termination

We may suspend or terminate your account immediately, with or without notice, if:

• You violate these terms or our acceptable use policy.
• We are required to do so by law or by Amazon Web Services.
• Your account is associated with fraudulent activity.

You may close your account at any time. On closure, your data is permanently deleted in accordance with our Privacy Policy.

9. Limitation of liability

To the maximum extent permitted by applicable law, sendvia.io and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, or business interruption, arising out of your use of or inability to use sendvia.

Our total aggregate liability for any claim arising under these terms shall not exceed the greater of (a) the amounts paid by you to us in the twelve months prior to the claim, or (b) $100 USD.

10. Disclaimer of warranties

sendvia is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Governing law

These terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to these terms

We may update these terms from time to time. Material changes will be communicated by updating the effective date. Continued use of sendvia after a change constitutes acceptance of the revised terms.
